What Albany's ADU amnesty rule means for a fireplace
The City of Albany's ADU Amnesty Program will not grant a permit for an ADU or JADU with listed substandard conditions. Those conditions include fireplaces or chimneys that list, bulge or settle due to defective material or deterioration. Who the rule applies to
It applies to owners asking the City to permit an existing accessory dwelling unit or junior accessory dwelling unit through the amnesty program. If that unit has a fireplace or chimney that leans, bulges outward or has sunk because the material is defective or has worn down, the City lists it as a substandard condition. Under the program, a unit with a listed substandard condition does not get the permit.
What it changes about the repair
For most homeowners, a cracked or tired fireplace is something to fix when convenient. For an ADU going through amnesty, a fireplace that lists, bulges or settles stands between the owner and the permit, so it makes sense to get it looked at early. Repair can mean rebuilding damaged brick and mortar, restoring the firebox, or correcting the structure so it no longer leans or sinks. The City makes the decision on the permit. Our part is the repair.
Signs to point out when you request an estimate
- The fireplace face or hearth tilts away from the wall or floor
- Brick or stone pushes outward in a bulge
- Gaps open between the fireplace and the surrounding wall
- The hearth or firebox has dropped or cracked across
- Mortar joints are crumbling or missing
- Smoke comes into the room when a fire is lit
How the job goes
Look at the fireplace
We check the firebox, brick and mortar, damper and draft, and note any lean, bulge or settling.
Free estimate
You get a clear explanation of what we found and an estimate before any work starts.
Repair
We carry out the agreed work, whether that is brick fireplace repair, firebox rebuilding or correcting a draft problem.
Repairs don't decide the permit
Fixing a fireplace that lists, bulges or settles takes one listed condition off the table. Whether an ADU or JADU qualifies for an amnesty permit is decided by the City of Albany Community Development Department.
Fireplace repair in brief
Fireplace repair covers the parts you can see and the parts behind them: cracked or loose brick and mortar, a worn firebox, a smoke chamber that is breaking down, a damper that won't seal, damaged doors or glass, and draft problems that push smoke into the room. We work on wood-burning and gas fireplaces and on all major brands. We look first, explain what we found, and give a free estimate before any work starts. For the full scope, read how fireplace repair works.
When repair fits and when another job fits better
- Repair fits when you can point to the problem: a leaning or bulging face, cracked brick, a broken damper, damaged glass or a smoky fire.
- An inspection fits better when you don't know what's wrong, or you want the whole system checked before an ADU application. Book chimney inspection for homes in Albany first, and any repair can follow from what it finds.
- Chimney repair fits when the lean, bulge or crumbling masonry is in the chimney above the fireplace, including the part above the roofline.
- A conversion may fit if you're weighing a fix against switching fuel. Our guide comparing gas and wood-burning fireplaces covers the trade-offs.
