Albany's ADU amnesty program and your chimney
The City of Albany Community Development Department's ADU Amnesty Program Sub-Standard Housing Assessment states that the program will not grant a permit for an ADU or JADU with listed substandard conditions, including fireplaces or chimneys that list, bulge or settle due to defective material or deterioration.

Who the rule applies to
The rule applies to owners seeking a permit through the ADU Amnesty Program for an accessory dwelling unit (ADU) or a junior accessory dwelling unit (JADU). If that unit has a fireplace or chimney, its condition is part of the assessment. A chimney that leans, bulges or has settled because the material was defective or has deteriorated is one of the conditions that stops the permit.
What it changes about the inspection
A routine inspection mostly asks whether the system is safe to use. That means checking for blockages, creosote, cracks in the flue and problems with the damper and firebox. For an ADU or JADU going into the amnesty program, the structural questions come first. Is the chimney standing plumb? Is the masonry pushing outward anywhere? Has it sunk or pulled away from the wall? And is the cause defective material or deterioration?
What we look for on an ADU or JADU chimney
- Lean: whether the stack stands plumb along the wall and above the roofline
- Bulging: brick or stone pushing outward, often alongside cracked or missing mortar
- Settling: a gap opening between the chimney and the wall, cracks stepping through mortar joints, or a hearth or firebox that has dropped
- Material and deterioration: spalling brick, eroded mortar, a cracked crown and water damage that weakens masonry over time
- Inside the flue: cracked or offset liner sections that can match movement seen outside
When the outside shows signs of movement, a more detailed level 2 inspection with a camera run through the flue can show whether the liner has cracked or shifted as well.
When the chimney does lean, bulge or settle
The inspection describes what was found, where it is and what would correct it. The fix itself is separate work. Depending on how far the damage goes, it can mean masonry repair, tuckpointing, crown repair, or a partial or full rebuild.
The city makes the permit decision
An inspection documents the chimney's condition and what would correct it. It does not replace the city's own assessment, and only the city decides whether the program grants a permit.

Chimney inspection in brief
A chimney inspection covers the system from cap to firebox. Outside, that means the crown, flashing and masonry. Inside, it means the damper, smoke chamber and flue, plus the firebox and hearth where the fire burns. The inspection looks for damage, blockages such as nests or debris, creosote buildup and anything else that affects safe use. On gas fireplaces, the venting is checked too. You get a plain explanation of what was found and what, if anything, needs doing. For the full scope, read how chimney inspection works.
When an inspection fits, and when something else does
An inspection is the right first step when you don't know the chimney's condition. Common examples are before an ADU or JADU permit application, before using a fireplace that has sat unused, and after shaking or a storm when you can't tell whether anything moved. Shaking can crack mortar joints and flue liners in ways you can't see from the ground. Read more about chimney damage after an earthquake.
Another service fits better when the problem is already clear. A visible leak around the chimney, a missing or broken cap, cracked firebox panels or a flue that only needs sweeping can each be booked directly as a repair or cleaning.
